END USER TERMS OF USE

These End User Terms of Use ("End User Terms") govern your participation in the HomeSurvey.ai / SurveyIQ™ survey workflow operated by HelixIQ, Inc. ("HelixIQ," "we," "us," or "our"). By accessing or using the Services, submitting photos or videos, or otherwise participating in a survey, you agree to these End User Terms.

If you do not agree, do not use the Services.

1. PURPOSE OF THE SERVICES

The Services allow you to capture and submit photos, videos and voice notes of a property and its contents, and to answer questions about your move, at the request of a moving company, insurer, or other business ("Subscriber"). The Services may be accessed directly or through an integrated platform such as Movegistics or another system. Your survey, including your contact details, photos, videos, voice notes and transcripts, answers, and the inventory and summary generated from them, is provided to the Subscriber and may be sent to the systems the Subscriber uses to run its business, such as its CRM or move-management software.

The Services use automated systems and artificial intelligence to generate draft outputs for Subscriber review.

2. AI OUTPUTS ARE DRAFTS ONLY; NO GUARANTEES

You understand and agree that:

  • The Services use AI and automated systems.
  • Any inventory or other output is a draft and may be inaccurate or incomplete.
  • The Services do not provide professional advice (including legal, insurance, valuation, or financial advice).
  • Subscriber (not HelixIQ) is responsible for reviewing and finalizing outputs.

3. YOUR RESPONSIBILITIES

You agree to:

  • Submit only content that you are authorized to capture and share.
  • Obtain consent from individuals who appear in your content.
  • Follow Subscriber instructions regarding what to capture.
  • Avoid uploading sensitive personal data (government IDs, financial account numbers, payment card data, medical information).

4. CONSENT AND AUTHORIZATION

By submitting content, you represent that:

  • You have permission to record at the location shown.
  • You have permission to capture the items shown.
  • Individuals appearing in your content have consented to being recorded.

HelixIQ does not verify identity, ownership, consent, or recording legality.

5. CONTENT LICENSE

You grant HelixIQ a limited, non-exclusive, royalty-free license to process and transform your submitted content solely to operate, maintain, secure, and improve the Services, and to provide your content and the outputs to Subscriber and to the systems Subscriber directs us to send them to.

6. PRIVACY

Your use of the Services is governed by the HomeSurvey.ai Privacy Policy.

If you access the Services through a third-party platform (such as Movegistics), your information may also be subject to that platform's terms and privacy policy.

Once your survey is delivered to the Subscriber or to a system the Subscriber uses, the Subscriber's own privacy policy governs how the Subscriber uses it. Please contact the Subscriber with questions about its use of your information.

7. TEXT MESSAGES

If you give your mobile phone number to a Subscriber or to us, you agree to receive text messages about the survey or move you are participating in, such as survey links, reminders and status updates. These messages are sent by HelixIQ, Inc. on behalf of the Subscriber and may come from a phone number registered to the Subscriber. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for assistance. Carriers are not liable for delayed or undelivered messages. How we handle mobile numbers and SMS consent is described in the HomeSurvey.ai Privacy Policy.

7A. EMAILS

If you give your email address to a Subscriber or to us, you agree to receive emails about the survey or move you are participating in, such as survey links, reminders and confirmations. These emails are sent by HelixIQ, Inc. on behalf of the Subscriber. HelixIQ may also send you occasional announcement emails about HomeSurvey.ai. Every announcement email has an unsubscribe link, and you can unsubscribe at any time; unsubscribing does not stop emails about a survey you are taking part in. Any marketing emails from the Subscriber are the Subscriber's responsibility and are governed by its own policies.

8. SERVICE AVAILABILITY AND LATENCY

The Services are provided "AS IS" and "AS AVAILABLE." Processing delays, interruptions, or performance variability may occur due to network, device, system, or AI model conditions.

9. PROHIBITED USE

You agree not to misuse the Services, interfere with operation, submit unlawful content, or attempt to reverse engineer or extract system logic.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

To the maximum extent permitted by law, HelixIQ disclaims warranties and is not liable for indirect or consequential damages arising from your use of the Services.

11. GOVERNING LAW

These End User Terms are governed by the laws of the State of California, USA. Courts located in Sacramento County, California have exclusive jurisdiction over any dispute under these End User Terms.
